This U.S. Privacy Notice (“Privacy Notice”) provides additional details about our practices regarding the collection, use, and disclosure of personal information of individuals who reside in U.S. states that have enacted privacy laws such as California, Colorado, Virginia, Utah, and Connecticut. These privacy laws are collectively referred to as “US State Privacy Laws."

For the 12-month period prior to the date of this Privacy Notice, Tru Earth has collected and used the following categories of Personal Information:

How do we collect your Personal Information

Tru Earth collects these categories of Personal Information from the following sources:

  • Directly from the individual the information is about.
  • From our service providers or other third parties
  • Indirectly from an individual’s interaction with our website or our products.

How do we use and disclose your Personal Information

We use and disclose Personal Information according to the purposes established in the “How do we collect and process your Personal Information?” and “Who has access to your Personal Information?” sections of our Global Privacy Notice.

Sale or Sharing of Personal Information

We do not sell or share your Personal Information with third parties for monetary gain. However, under the California Privacy Rights Act (CPRA), 'sharing' includes disclosing or making available Personal Information to third parties for cross-contextual behavioral advertising, a practice also considered “targeted advertising” by other state privacy laws.

Within the last 12 months, we have “shared” the following categories of your Personal Information with our advertising and social network partners to perform services on our behalf: identifiers, online activity information, and inferences drawn from Personal Information. This sharing enables marketing, audience measurement, and the delivery of advertisements we believe may interest you.

We do not and will not knowingly “sell” or “share” the Personal Information of minors under the age of 18. 

Cookies and Similar Tracking Technologies

When you visit or use this website, cookies and similar technologies may be used by our online data partners or vendors to associate your activities on our website with other personal information they or others have about you, including your email address. One of these service providers we work with is retention.com, which uses this information to send communications and marketing to your email address, including prompts when you have an abandoned cart. What privacy rights do you have?

Individuals who reside in states with US State Privacy Laws have certain rights regarding the collection, use and disclosure of their Personal Information. These rights vary by state. If the state in which you reside mandates it, we will provide you with the following rights:

  • Right to opt-out of sharing your Personal Information for cross-context behavioral advertising or targeted advertising;
  • Right to data portability, which means that you may request that we provide you a copy of specific pieces of Personal Information we have collected about you in the past 12 months in an electronic format;
  • Right to request to know about the Personal Information we process about you or acknowledge the processing of your Personal Information;
  • Right to request that we correct your Personal Information;
  • Right to request that we delete your Personal Information;
  • Right to request that we limit the processing of your Sensitive Personal Information;
  • Right to opt-out of the processing of your Sensitive Personal Information;
  • Right to appeal the denial of a request; and
  • Right to lodge a complaint with the privacy authority in your State.

For individuals who reside in California, once we receive your request to disclose how Tru Earth has collected, used, and shared your Personal Information in the last twelve months, we will verify your identity and provide the following information:

  • Categories of Personal Information collected about you by Tru Earth.
  • Sources from which we obtained your Personal Information.
  • Purposes for using your Personal Information.
  • Third parties with whom we shared your Personal Information.
  • Whether we sold or shared your Personal Information for the benefit of Tru Earth.

Do Not Track

Some internet browsers may be configured to send “Do Not Track” signals to the websites that you visit. We currently do not respond to “Do Not Track” or similar signals.

Rights under California Shine the Light Law.

California’s “Shine the Light” law permits our users who are California residents to request and obtain from us a list of what Personal Information (if any) we disclosed to third parties for their own direct marketing purposes in the previous calendar year and the names and addresses of those third parties. However, we do not disclose Personal Information protected under the “Shine the Light” law to third parties for their own direct marketing purposes.

Authorized agent

You may designate an authorized agent to make requests on your behalf. We will require verification that you did, in fact, authorize the agent. Unless the law requires otherwise, your authorized agent must provide contact details for you. We will contact you to confirm that you authorized the agent. Once you confirm, we will promptly respond to the rights request.

Automated decision-making

Tru Earth does not perform any automated decision-making with the personal information that we collect about you and do not plan to do so without further notice.

In order to fulfill your request, we may require additional Personal Information for the purpose of verifying your identity.

We aim to respond to your requests within the established 45 days from receipt. If we require more time to respond, we will let you know within this period. We will deliver our response by mail or electronically, depending on your preference.

We will not discriminate against you for exercising your Personal Information rights.
